The prison sentence is a custodial sentence. He was charged with "Moharebeh" according to Articles 279 and 282 of the Islamic Penal Code, and with "being a member of opposition groups" according to Article 499. Based on Article 134 of the Islamic Penal Code, the court has decided that only the most severe of all the punishments determined for the defendant is applicable. Abdolhamid Mirbaluchzehi, Mahmoud Kalkali, Omid Imani, and Ali Reza Bampouri were also sentenced, by the same branch of the Islamic Revolutionary Court, to 15 years in prison on charges of "being a member of opposition groups." The sentence is a custodial sentence. Yet, these individuals have been acquitted of the charge of "Baghy (taking up arms against the Islamic government)" for the following reasons: > 1- no use of weapons or involvement in armed conflicts 2- no significant involvement in the Jaish al-Adl group; the court recognizes involvement with this group as Baghy only if the person is one of the group's central figures. 3- insufficiency of evidence." It should be noted that their acquittal was issued based on Principle 37 of the Constitution of the Islamic Republic of Iran, and Article 265 of the Islamic Republic’s Code of Criminal Procedure. Saeed Dadgar, another defendant of the case, was sentenced to five years in prison on charges of "being a member in an opposition group. According to the IRGC report, only two of the accused -- Khald and Abdul Hamid Mirbaluchzehi --took part in armed activities. The report claimed that Dehghan Khold and Mirbaluchzehi were present in the Kuh Birak armed clash that led to the killing of two IRGC soldiers. According to the report, Khald and Zahi had also planned other armed acts which were not carried out.
