Shaker Behrouz
Shaker Behrouz (Shaker Behrouz Dizaj) was a member of one of the Kurdish parties before returning to Iran. He returned to Iran on a safe-conduct but arrested by the IRGC later. He was sentenced to death on the charge of "Baghy (armed rebellion against the state)."
Shaker Behrouz is accused of "murdering" a Basij member. The Revolutionary Court sentenced him to death on the charge of "Baghy (armed rebellion against the state)." According to the Islamic Penal Code, Baghy refers to individuals or groups who commit armed action against the Islamic government. The alleged charge of "Baghy" may have been made without a legal basis due to the General Courts vote on acquitting him of "carrying and keeping weapons." <symbol-timeline></symbol-timeline>

He was notified of this sentence on December 26th. This court branch had previously passed a decree that the branch was "not qualified" to investigate Shaker Behrouzi's case. It is not clear why the same branch eventually re-examined the case. The judge pointed out that the defendant had not confessed in court in his verdict. It was then stated that the sentence was pronounced based on the judge's knowledge of Article 211 of the Islamic Penal Code. Shaker Behrouz had told the judge: > All my confessions during my temporary detention have all been obtained under torture." The judge considered this statement unacceptable to the court for lack of sufficient evidence. Shaker Behrouz is convicted of this crime, while 12 people would testify that he was in a shop in Dizaj town, located in the suburbs of Urmia city, at the time the murder took place and that Mr. Behrouz was present, with others, at the victim's bedside immediately after anonymous individuals had injured the victim. They have also stated that he even assisted the victim in admitting him to the hospital. Still, the court refuses to hear the witnesses' statements. According to an informed source, the judge has claimed that "after the investigation of the discovered cartridges along with the legal medicine report, it has been concluded that Mamel Mohammadi, the dead victim, and Farigh Azadikhah, the surviving victim, have been shot using the same weapon.” The verdict explicitly states that Shaker Behrouz "has confessed to having taken part in the failed assassination of Farigh Azadikhah. In contrast, in February 2019, the judge at Branch 110 of the Second Urmia General Court acquitted Mr. Behrouzi of this accusation, citing the following reasons: > Mr. Azadikhah's cousin has testified that Mr. Behrouz assisted the wounded person. The injured party has not filed a complaint against Mr. Behrouz. Mr. Behrouz has not confessed to this crime. And no weapons have been discovered. According to an informed source who has studied the case file: > The verdict of "not guilty" has already been reached and passed for the following accusations against Mr. Behrouzi: > illegally leaving and entering the country, using a firearm, and injuring a person (Farigh Azadikhah) with a gun. > However, the court has requested filing a case at the Prosecutor's Office for the charges mentioned above and for intentionally injuring Himan Mohammadi (the victim's son) with a gun. It should be noted that during the investigation of this case, two other political prisoners were also interrogated like suspects.
